1.2 These Terms, the Disclaimer, the Privacy Policy and the Cookie Policy (together, the “Policies”) form your agreement with us. Ticking the boxes and clicking “I Agree and Continue” is a valid, binding acceptance, and we keep a record of it. If you do not agree, do not use the Portal.

3. Eligibility and your duties
3.1 You must be at least 18 years old and competent to contract under the Indian Contract Act, 1872. A person under 18 may use the Portal only after verifiable consent of a parent or lawful guardian, as Section 9 of the Digital Personal Data Protection Act, 2023 (“DPDP Act”) requires.
3.2 You must give true, complete and current registration details and keep them updated.
3.3 In line with Section 15 of the DPDP Act, you must comply with all applicable laws, must not impersonate anyone or suppress material information, must not file false or frivolous complaints, and must give only verifiable and authentic information when asking us to correct or erase data.
4. Nature of the service
4.1 The Portal is a facilitation platform. We provide the technology and themes. We do not create, verify, select or endorse your Content.
4.2 You may choose between the available themes and change them. We may add, change or withdraw features and themes.
4.3 You receive a limited, personal, non-transferable right to use the Portfolio Website. It is not a sale of a domain, hosting or software.
4.4 We do not promise that you will get customers, enquiries, income or any business result. Our training or placement assistance never guarantees employment or clientele.
5. Account security
Keep your mobile number and password confidential and do not share your login. You are responsible for all activity under your account. Tell us at once at legal@uk-international.in if you suspect misuse. We may reset or suspend an account to protect security.
6. Your responsibility for Content
6.1 You are solely and fully responsible for all Content, its accuracy, its legality and its consequences. You own it or hold all rights and permissions to publish it.
6.2 If your Content shows or names any other person (client, model, friend, staff, student), you confirm you took that person’s clear prior consent to photograph them and to publish their image and details. For anyone under 18 you must hold the written consent of a parent or guardian.
6.3 Qualifications, certificates, awards, experience, prices and service claims must be true. Do not make medical or treatment claims you are not qualified or permitted to make, and do not publish edited or borrowed before-and-after photographs.
6.4 Do not use the name, logo or marks of the Institute, UK International or any brand in a way that suggests a branch, franchise, endorsement or partnership, unless we approve it in writing.
7. Prohibited Content and conduct
You must not upload, publish, link to or send anything that:
a) contains nudity, partial nudity, sexually explicit, indecent or obscene material, or appeals to prurient interest (Sections 67 and 67A, Information Technology Act, 2000; Bharatiya Nyaya Sanhita, 2023);
b) shows or sexualises a child in any way (Section 67B, IT Act; POCSO Act, 2012);
c) violates anyone’s privacy, including private images published without consent (Section 66E, IT Act);
d) is defamatory, abusive, threatening, harassing or hateful, or promotes violence or discrimination;
e) is false, misleading, fraudulent or impersonating, including fake reviews, fake certificates and deceptive offers;
f) infringes copyright, trademark or other rights, including photographs and videos copied from other artists, brands or websites;
g) carries malware, phishing links, or links to adult, gambling or unlawful sites;
h) promotes illegal activity, banned products or unlicensed procedures;
i) is otherwise unlawful or brings disrepute to the Institute, its staff or students.
You must not hack, scrape, copy, reverse engineer or disrupt the Portal, or use it to send spam.
8. Visitor data collected through your Portfolio Website
8.1 If your Portfolio Website has an enquiry form, or a call, WhatsApp or map button, you decide why and how Visitor details are used. You are responsible for lawful use of that data, and the Institute only hosts and processes it on your behalf.
8.2 Use Visitor details only to answer their enquiry. Do not sell or share them, misuse them or send unsolicited promotions with them, and delete them when no longer needed. Tell Visitors how you will use their data where you collect it.
9. Monitoring, moderation and removal
9.1 We have the right, but not the duty, to monitor, review and audit all Content and activity, using automated tools and human reviewers. Our review is not approval, and not removing something does not make us responsible for it.
9.2 If we find or reasonably believe that Content or conduct breaches the Policies or any law, or we receive a complaint or an order of a court or authority, we may, in our discretion and with or without notice:
a) strike off, edit, hide or delete the Content;
b) disable features or suspend your Portfolio Website;
c) permanently block your account and remove your Portfolio Website;
d) keep records and share them with courts, police or authorities as the law requires;
e) take disciplinary action under the Institute’s rules where you are an enrolled student, and pursue legal remedies.
9.3 We may remove nudity, content involving children, privacy violations and unlawful content immediately and without notice. We act on court or government orders within the time the Intermediary Rules prescribe.
9.4 You may write to the Grievance Officer within 15 days against a removal. Our decision is final, subject to your legal rights. No refund or compensation is due for removal under this clause.
9.5 As the Intermediary Rules require, we will remind you of these rules and of our right to remove Content at least once every year.
10. Licence and intellectual property
10.1 You keep ownership of your Content. While your Portfolio Website is active you give us a non-exclusive, royalty-free licence to host, store, display, resize and technically process it to run the Portal.
10.2 We use your name, photographs or work in our own promotion only if you tick box 4 on the consent page or give written permission. You may withdraw it for future use.
10.3 The Portal, software, themes, designs, code, logos and trademarks belong to the Institute or its licensors. Do not copy, resell or sub-license them.
11. Intermediary status
We act as an “intermediary” under Section 2(1)(w) of the IT Act. We do not start the transmission of your Content, choose its receiver, or select or modify it, and we observe due diligence under the Intermediary Rules to keep the protection of Section 79 of the IT Act.
12. Indemnity
You will indemnify and hold harmless the Institute, its owners, directors, partners, staff and affiliates against all claims, penalties, losses, damages and legal costs (including advocate fees) arising from your Content, your breach of the Policies or any law, or any claim by a third party, including a person shown in your photographs or a Visitor.
13. Fees and refunds
Fees, if any, paid or charged are non-refundable and non-transferable unless we state otherwise in writing. We may suspend a website for unpaid dues.
14. Suspension, termination and exit
14.1 You may ask us at any time to delete your Portfolio Website and account.
14.2 We may suspend or end your access for breach of the Policies, legal requirement, end of your course or enrolment, or technical reasons.
14.3 On termination the website goes offline and your data is handled under the Privacy Policy. Except where Content was removed as unlawful, we will try to let you download your Content within 7 days. After that we are not liable for its deletion.
15. Changes to the Policies
We may update the Policies. We will tell you on login and by SMS, and for material changes we will ask for your consent again. If you do not accept, you may stop using the Portal and ask for deletion of your data.
16. Governing law and disputes
Indian law governs these Terms. Disputes are first taken to the Data Protection Officer/Grievance Officer. Subject to law, the courts at Delhi have exclusive jurisdiction.
17. Contact and grievance
See Section 15 of the Privacy Policy for the Data Protection Officer and the Grievance Officer.
18. General
If any clause is invalid, the rest stays in force. Our delay in enforcing a right is not a waiver. You may not assign your rights. We are not liable for failure caused by events beyond our control. The Policies are the entire agreement on the Portal.
